Educational brand, not an advisory firm
The Merrick Spitters Reset Report™ is jointly owned intellectual property of Adrian C. Spitters and Peter J. Merrick. It is an educational marketing and publishing brand, not a separate legal or regulated entity. Using the website does not create a professional relationship.
1. Acceptance and scope
These Terms govern the website, newsletters, articles, white papers, downloads, subscription pages, forms and other content presented under The Merrick Spitters Reset Report™. By using the content, you acknowledge these Terms. Consent required by privacy, anti-spam or other law is obtained separately and is not inferred merely from website use.
In these Terms, “the publishers,” “we,” “us” and “our” mean Adrian C. Spitters and Peter J. Merrick jointly, solely in their editorial and publishing capacities, unless another person or organization is expressly identified. This wording does not create a partnership, advisory firm or other legal entity.
2. General information and education only
Content is provided for general education, commentary and discussion. It is not personal financial, investment, securities, insurance, portfolio-management, tax, accounting, legal or other professional advice and is not a recommendation to take or refrain from any action. Individual circumstances, laws, tax rules, products and market conditions differ and change.
3. No professional relationship
Reading content, subscribing, downloading material, submitting a form, sending a message or booking an introductory meeting does not create a client, adviser, dealer, insurance, fiduciary, tax, legal or other professional relationship. A relationship arises only through the responsible person or legal organization identified in separately completed engagement, account, referral, insurance or other governing documents.
4. Separate professional capacities

PFC planning and advisory work Performance Financial Consultants Ltd., operating as PFC Wealth Solutions™, under its own engagement and disclosure documents.
Insurance Adrian’s individual insurance licences are active in British Columbia and Ontario. Peter is individually and personally licensed as an insurance advisor in Ontario only through MAX Financial Ltd. PFC’s corporate insurance agency licence is active in British Columbia and pending in Ontario. Insurance business is processed through MAX Financial Ltd., applicable insurers and their governing documents.
Axcess relationships Adrian acts separately as an Axcess Capital Advisors Inc. Dealing Representative when performing registration-dependent activity. Peter’s separate Axcess relationship is referral-only and may include alternative-investment and private-wealth referrals.
Discretionary portfolio management The independently registered portfolio manager under its own agreement, registration, custody, fees and disclosures.
Peter’s professional services The separate person or legal organization identified in the applicable engagement and disclosure documents. Reset Report content does not create that engagement.
Capacity must be identified
A link, biography, article or joint publication does not merge PFC, Axcess, an insurer, portfolio manager, Peter’s separate professional practice or any other organization. Their respective terms, privacy policies, engagements and regulatory responsibilities apply.
5. No offering or solicitation
Website content is not a prospectus, offering memorandum, insurance illustration, quotation, application, trade instruction or solicitation to buy or sell a security, insurance product, precious metal, business interest or other asset. Registration-dependent activity and product-specific disclosure occur only through the responsible regulated firm or person and current governing documents.
6. Risk and suitability
Private and exempt-market investments, precious metals, insurance, real estate, private credit, tax-advantaged strategies and other assets discussed may involve material risks, costs, restrictions, conflicts and tax consequences. They may be speculative, illiquid, difficult to value, subject to loss and unsuitable for a reader. Educational discussion does not establish suitability or eligibility.
7. Compensation, books and third-party relationships
The publishers may receive book royalties, speaking fees or income from separately disclosed professional activities. MAX Financial Ltd. or an insurer may pay insurance compensation directly to Adrian or Peter in their individually licensed capacities, to PFC where permitted, or through a disclosed combination. Under their separate revenue-sharing agreement, Peter shares applicable insurance revenue with Adrian for business processed through MAX Financial Ltd.
Adrian’s Axcess compensation may include referral compensation and dealing-representative compensation connected with his registered activity. Peter’s Axcess compensation is referral compensation only under his separate alternative-investment and private-wealth referral arrangement. Adrian shares applicable Axcess referral revenue with Peter under their agreement; this does not characterize Peter as receiving dealing-representative compensation. A separately documented portfolio-manager referral arrangement may result in referral compensation to the payee identified in its governing disclosure.
New World Precious Metals may pay qualifying direct-referral compensation to Performance Financial Consultants Ltd. under the governing referral arrangement. Adrian shares the resulting New World referral revenue with Peter under their separate agreement. Adrian does not currently receive the New World payment directly in his personal capacity. The New World arrangement and each applicable MAX and Axcess compensation arrangement are disclosed before the client engages with the applicable organization and in any required governing documents.
Sponsored content, paid endorsements, affiliate links or other material connections must be clearly identified near the relevant content when they exist. A general website disclaimer does not replace a transaction-specific or client-specific disclosure.
8. No guarantees and forward-looking information
No result is guaranteed. Forecasts, scenarios, opinions and forward-looking statements rely on assumptions and may differ materially from actual events. Past performance, historical relationships and illustrative examples do not guarantee future results. References to asset protection, resilience, security, de-risking or wealth preservation describe objectives or analytical frameworks, not certainty of outcome.
9. Accuracy, editorial judgment and third-party information
The publishers seek to provide useful content but do not warrant that it is complete, current, error-free or suitable for a particular purpose. Content may include opinion and editorial judgment. Third-party information may not have been independently verified. Readers should review current official and client-specific documents before acting.
10. External websites and service providers
Links to PFC, Axcess, insurers, portfolio managers, precious-metals organizations, publishers, book retailers, regulators, social-media platforms, scheduling tools or other parties are provided for convenience. The publishers do not control or guarantee their content, availability, security, products, services or privacy practices. Their own terms and policies apply.
11. Intellectual property
Unless otherwise stated, The Merrick Spitters Reset Report™, its articles, white papers, frameworks, books, designs, names and related content are owned by or used with permission of the applicable rights holders. The Merrick Spitters Reset Report™ is jointly owned intellectual property of Adrian C. Spitters and Peter J. Merrick.
A reasonable copy may be printed or saved for personal, non-commercial use. Content may not be reproduced, republished, modified, sold, framed, scraped, used to train a commercial system or commercially exploited without permission from the applicable rights holder, except as permitted by law.
12. Responsible use
- Do not use the website unlawfully or to infringe another person’s rights.
- Do not attempt unauthorized access, introduce malicious code, disrupt service or bypass security controls.
- Do not misrepresent identity, affiliation, authorization or the source of content.
- Do not collect content or personal information through automated means contrary to law or posted instructions.
13. Privacy and electronic communications
The Reset Report Privacy Policy describes information controlled by the publishers. A collection point that routes information to PFC, Peter’s separate professional practice or another organization must identify that controller and link to its applicable privacy notice. Newsletter messages include identification and an unsubscribe mechanism where required.
14. Limitation of liability
To the maximum extent permitted by law, the publishers, contributors and service providers are not liable for indirect, incidental, special, consequential or punitive loss arising from reliance on general content, third-party links, unauthorized use or temporary unavailability. Nothing excludes liability that cannot lawfully be excluded or limits duties under a separately executed agreement or applicable law.
15. Governing law, changes and contact
These Terms are governed by the laws of British Columbia and applicable federal laws of Canada, without limiting mandatory rights that apply in another jurisdiction. The publishers may update these Terms when content, technology, law or relationships change. The current version will be posted with its effective date.
